1. Service Description – TopTip Drive & VPN
(1) TopTip Drive is a personal cloud storage solution with a browser-based interface and server-side operations located in German data centers. Each user receives a logically separated storage area.
(2) Access to data is provided via a web interface, synchronization software, and mobile apps.
(3) Data is stored on redundant storage systems (e.g., RAID) to increase reliability. RAID systems do not constitute a backup and do not replace independent data backups by the customer.
(4) Optional VPN Access: If included in the selected package, the provider offers VPN access (based on “Outline” software). This service is intended for the encrypted transmission of data and the protection of privacy, particularly in public networks.
(5) The use of third-party software (e.g., Outline client, OnlyOffice) is at the customer’s own risk. The provider does not guarantee permanent compatibility with all end-user devices.
(6) The customer remains responsible for the independent backup of their cloud data.
2. Fair Use Traffic & Usage Limits
(1) For stable operation of the cloud storage, a fair-use limit of 10 TB data transfer per month applies.
(2) For the VPN service, a Fair Use Policy applies. The service is designed for standard personal use (e.g., secure browsing, remote work, occasional data transfer).
(3) The Fair Use offer does not cover permanent use for bandwidth-intensive services that exceed the scope of an individual user. This includes, in particular:

Permanent 4K/UHD video streaming via the VPN tunnel,

Operation of file-sharing services or torrents,

Use of the VPN as a gateway for entire local networks or commercial server structures.
(4) In the event of usage that jeopardizes the overall stability of the system, the provider may throttle the connection speed or temporarily restrict access.
3. Customer Obligations & Prohibited Use
(1) The customer is responsible for the legality of the stored data and for all activities conducted via their VPN access.
(2) The VPN service must not be used for unlawful purposes. Prohibited activities include, but are not limited to, copyright infringement, sending spam emails, hacking attempts, or bypassing third-party security measures.
(3) Since the VPN service is implemented using shared IP addresses, the customer has no claim to an exclusive or static IP address.
(4) In the event of a breach of these obligations, the provider is entitled to immediately suspend access.
4. Availability and Maintenance
(1) Cloud data is stored on servers in Germany. VPN server locations (e.g., Germany, USA, Finland) may vary; there is no permanent claim to a specific location.
(2) Maintenance work may lead to short-term restrictions. Disruptions caused by force majeure or outages at upstream service providers (data center operators) are beyond the provider’s control.
5. Contract Duration and Termination

Minimum term: 12 months.

Automatic renewal for another 12 months unless cancelled 4 weeks before the end of the term.

Renewal invoices are issued approximately 1 month before renewal.

Special Offer: The “Pay for 2 years – Use for 3 years” offer extends the term once to 36 months. The right to terminate at the end of this term remains unaffected.

Data deletion occurs no later than 30 days after the end of the contract.
6. Prices and Payment

Billing is annual in advance. Payment term: 14 days.

In the event of non-payment, access (Cloud and VPN) may be suspended. The obligation to pay remains in effect.
7. Liability

Unlimited liability for intent and gross negligence.

In cases of simple negligence, liability is limited to material contractual obligations (cardinal obligations) and restricted to foreseeable damages.

The provider is not liable for damages resulting from the suspension of access due to misuse (according to Section 3).
8. Right of Withdrawal (for Consumers)

Withdrawal period: 14 days from the date of contract conclusion.

The right of withdrawal expires prematurely if the provider has begun performing the service (provision of storage/VPN key) at the express request of the customer.
9. Data Protection
The privacy policy published on the website applies. When using the VPN service, no logs of individual user behavior (visited websites, etc.) are created.
